本文通过对检察权的产生和发展历史的综合考察,分析比较了中西现代检察权与古代检察的变化与发展,梳理评析了中西已有的检察权基本理论;从检察权产生的理论基础、权力的归属、行为特征、权能组合的异质同构、权力的位阶、检察权功能的现代转型等视角,剖析了现代检察权的个性特征;通过比较分析检察权与法律监督权在性质、权力功能配置和实现方式等方面的差异,指出了中国检察权定位为法律监督属性的历史局限性;结合现代检察权的发展规律以及中国的国情,论证了在中国宪政语境中检察权兼容法律监督权的合理性和正当性理由,提出了在相对合理主义下重新定位和解构中国检察权的基本思路;深入分析了检察权独立行使的合理性和正当性;在比较分析中西检察权独立构成要素的基础上,检讨了中国检察权独立的根本缺失在于精神要素、社会独立主体和内部独立操作规则的缺失,并提出了改革完善的基本思路。
