In my view , the orders of our legal inheritance are too few , so i make a proposition that the daughter and sons as well as their direted - related descendants should be ranged as the first group , the parents , as the second group , the sisters and brothers as well as their daughters and sons , as the third group , the grand - parents , as the forth group , the spouse , as the ring who can share the inheritance right with any of the the above groups
在笔者看来，我国法定继承的顺序太少，建议把子女及其直系卑血亲列为第一顺序继承人，把父母列为第二顺序继承人，把兄弟姐妹及其子女列为第三顺序继承人，把祖父母、外祖父母列为第四顺序继承人，配偶则可与各顺序的继承人共同继承。关于配偶的应继分，我国现行立法未规定先取权和用益权，对父母、祖父母、外祖父母等血亲继承人未规定遗产使用权，是其不足，应予补充、完善。
