论文首先厘清社会结构、信任结构与法律的一般关系，并对信任结构理论作了一般描述，之后结合中西社会的历史发展分析二者形成不同信任结构的原因与过程，并探讨了由于信任结构的不同所体现在中西社会中的几点基本差异。主要表现为三点：一是从社会发展的组织基础方面看，传统中国社会一直是以家族为本位的，而西方社会则较早地进入到一种以个人为本位的发展阶段；二是从社会的意识形态与所追求的价值目标来看，中西二者有求稳定与谋发展之别；三是从国家与政府的不同品格看中西迥异。在观察中西社会本身所显示出的基本差异之后，再来观察彼此社会中所运行的法律的原则与精神的基本不同便是顺理成章了。
