本文从分析刑事司法鉴定及其程序入手,比较两大法系关于刑事司法鉴定的启动、实施、质证、认证与采信等司法证明各环节的制度规定,透视我国刑事司法鉴定程序存在的基本问题,在此基础上提出:规定鉴定期限、对无鉴定结果不能进入诉讼或准司法程序的情况,当事人可以申请公证机关公证鉴定启动程序的真实性和合理性、建立鉴定人出庭作证制度、裁判者对鉴定结论认证通过质证程序形成心证的过程及理由应做出公开说明等有利于我国刑事司法鉴定程序改革的具体构想。
