| 3. | Article 38 anyone who smuggles goods that are subject to import or export prohibitions or restrictions , and hereby commits criminal offenses , shall be subject to criminal prosecution pursuant to the supplementary provisions on the punishment of smuggling crimes
第三十八条走私禁止进出口或者限制进出口的货物，构成犯罪的，依照惩治走私罪的补充规定追究刑事责任不构成犯罪的，依照海关法的规定处罚。 |
| 4. | Whoever illegally transports or carries guns into or out of the territory of china shall be investigated for criminal responsibility in accordance with the supplementary provisions of the standing committee of the national people ' s congress concerning the punishment of the crimes of smuggling
非法运输、携带枪支入境、出境的，依照《全国人民代表大会常务委员会关于惩治走私罪的补充规定》追究刑事责任。 |
| 5. | Article 156 whoever conspires with criminals of smuggling and provides them with loans , funds , account numbers , invoices or certificates or with such conveniences as transportation , storage and mailing shall be deemed an accomplice in the crime of smuggling and punished as such
第一百五十六条与走私罪犯通谋，为其提供贷款、资金、帐号、发票、证明，或者为其提供运输、保管、邮寄或者其他方便的，以走私罪的共犯论处。 |
| 6. | Article 40 for illegally importing or exporting technologies whose import or export is banned or restricted against this law , if the case is serious enough to constitute a crime , criminal responsibilities shall be affixed in reference to the supplementary provisions on punishing smuggling crimes
