故，笔者欲突破在商标及商标法框架下研究域名的思维定势，重新审视域名法律地位、分析其法律属性;以域名与商标冲突为典型，研究导致冲突的原因;从平等中立的角度，以贯穿经典案例的方法重新划分冲突分类:以横向比较分析的研究方法评介全球具有代表性的冲突解决方案和我国新的域名政策以及司法解释，为正确提出解决方案建立基础;探讨域名争议解决的主要原则，分析域名在我国的立法模式;最后，笔者将在全文分析的基础上，尝试提出域名权利问题，以期能从根本上寻求解决域名的法律保护以及冲突的公平解决的合理机制。
